I found my great-grandparents marriage entry. Never seen this sort of thing before! Where you normally find "After Banns etc" is:
"By Declaration in presence of Hugh McDougall Fishmonger Regent Street Hamilton and Robert Douglas scribble scribble Shed scribble". Where you normally find the Minister & witnesses there is:
"Warrant of Sheriff Substitute of Lanarkshire".
Anybody else got strange ones like this?
Did they elope?.....

If you search for irregular marriage you will get quite a few bits of information including a couple of stories based on marriages by declaration from Moonwatcher and me. They illustrate the legal position.

Sherriff Warrants

I have 2 or 3 of these on marriage certs in some of my lot - one was a soldier home on leave during WW1 and did not have time to post banns etc. Another I believe was a civil ceremony due to groom being Church of Scotland and Bride being RC. Another family villain in 1923 was married in a police station because he had been arrested !!

Among the many projects on my list for future attention is an investigation into the frequency of occurrence of irregular marriages as recorded in the statutory marriage registers.
It might only require a small amount of effort, as it may be the case the the Registrar General's annual report provided this very figure.
But the true figure can never be known as there was no legal requirement for the couple to seek a Sheriff's Warrant, or, after the time period for that possibility had expired, to seek other available legal remedies in order to ensure that the irregular marriage was subsequently registered in the GROS statutory Register of Marriages.
After such a declaration, whether or not later leading to an entry in the GROS Register of Marriages, - in the eyes of the law of Scotland they were married !!
(There was also a period during which it was possible to seek to be prosecuted by a Justice of the Peace, leading to a piece of paper which would also permit the registrar to make an appropriate entry in the Register of Marriages.)
It is a fundamental requirement to understand that "irregular" does not mean "illegal", but only not in accordance with the forms of the Established Church of Scotland, and those of other seceding presbyterian churches.
